CONSTITUTIONAL COURT OVERRIDES PROHIBITION OF BULLFIGHTS IN CATALONIA

Constitutional Court (TC) has overridden prohibition of bullfights that Catalan Generalitat approved in 2010, whereas that this decision encroached upon the state competences.

 


High Court has ruled – by majority of eight votes in favour and three against- that Catalan Executive went beyond its functions given on transfer management that it does in performances and animals protection matters.

Main argument of the sentence notes Catalonia has functions in public performances matters, and therefore, it can rule these, as well as in relation to animal protect.

This allows it to veto a specific public performance to protect bulls, but it can’t override a feast that is cultural heritage by decision of the national government, according sources from TC has informed EFE.

That is where Catalan functions encroach state functions, and also there is another key element on this point: laws laid down by central Executive (2013 and 2015), although these are subsequent to the Catalan law now overridden, have validity, among other reason because these have never appealed before own TC.

Thus, sources quoted have informed, which have added Constitutional has accepted on this base the appeal that Popular Group presented at Senate. The ruling will be based on a sentence that will be notified in the next day and it will have particular vote of the three dissenting judges.

Rapporteur of the sentence approved today is the judge Encarnacion Roca, proposed by CiU for TC with the agreement of PP and PSOE.

Functions of the Generalitat

In short, judge considers that functions of the Generalitat that allow it to manage animal protection and also performances of cultural and economic importance, but don’t overrode them.

PP appealed a paragraph of the Law for Animal Protection in Catalonia, and in concrete, a paragraph that overrode “fight between animals and other activities”.

In that paragraph, it was overridden bullfights and performances with bulls that included death of the animal and use of stage of ‘picas’, ‘banderillas’ and “sword”, as well as bull performances in any type that take place in or out of the bullring. Feast with bulls without damage for animal are excluded in this prohibition.

According to that appeal -supported by 50 senators-, Catalan prohibition violated Constitution because it went beyond decree of transfers for autonomous communities that allowed. The decree allowed autonomous communities to govern on these, but these have no functions to override them.

Also, appeal is based on main constitutional principle not written of the unity in the economic national order, that would be contravened by Catalan Parliament’s decision.

Bull business is an own economic market, of productions of goods and services, that is as an economic sector of prime importance (…) and is clear that a prohibitive rule is a distorting and destabilizing element on the market, that affect to other territories and several interests”, appeal argues.
