The criminal investigation against the pharmaceutical companies that is uncovered by The Wall Street Journal in the USA

New York / US federal prosecutors have opened a criminal investigation to determine whether pharmaceutical companies acted intentionally to flood the American society of strong analgesics or opioids, a crisis that has so far resulted in some 400,000 deaths since 1999.

 

 
With this objective, prosecutors use laws that normally prosecute drug traffickers, according to a source close to a case this week has uncovered The Wall Street Journal.

If the investigation curdles and criminal charges are filed, it could become the largest prosecution to date against pharmaceutical companies for allegedly contributing to the opioid epidemic in the USA, which would further intensify the legal problems of companies that they already face billionaire litigation in courts across the country.

Prosecutors are examining whether companies violated the Federal Controlled Substances Act, a statute that federal prosecutors have begun using against opioid manufacturers and distributors this year.

Six companies have been called

At least six companies have said, according to the Journal, that they received citations from the grand jury of the US prosecutor’s office in the Eastern District of New York: drug manufacturers Teva Pharmaceutical Industries, Mallinckrodt PLC, Johnson & Johnson and Amneal Pharmaceuticals, as well as distributors AmerisourceBergen Corp. and McKesson Corp.

A Johnson & Johnson spokesman quoted by the Journal said the company understood that the citation was part of a broader industry investigation, although the company thinks its policies and procedures to stop the use of opioid medications for non-medical purposes they complied with the law.

So far, in response to the demands of state and local governments, these companies denied responsibility for the opioid crisis. They have said that they follow all laws around the manufacture and distribution of prescription pain relievers.

The new macro-investigation is in its early stages and prosecutors are expected to cite more companies in the coming months.
