The Spanish Constitutional Court annul the Declaration of Independence of the Catalonian Parliament

The Spanish Constitutional Court has aned unanimously the Declaration approved by the Catalonian Parliament, in January 2013. This Declaration defines Catalonia as a “legal and political sovereign individual”. Nevertheless, the Court admits the right to decide if this process is made in a legal constitutional framework.

In the sentence notified today, the Court has deemed partially the appeal of unconstitutionality presented by the Government, so it declares “ and void” the first statement of the Declaration, which express that “the Catalonian people presents, due to democratic legitimacy, nature of a legal and political sovereign individual.”

It adds Constitution does not consider “recognizing the quality of sovereign of the Nation of Catalonia”, because of its incompatibility to Article 2 (on insoluble unit of the Spanish nation); and, on the contrary, it would lend to Catalonia “the power of break, by its own will”, this unit.

On the other hand, the Court declares the references to “the Catalonian people have the right to decide” constitutional, because it considers that can be understood in accordance with Magna Carta, since they not dedicate a right of self determination which is not recognised in the Spanish Constitution.

The Constitutional Court considers that these references to the right to decide mean a political aspiration which can only be reached by a process in accordance with the constitutional law, and with showing some respect for the “democratic legitimacy, pluralism, and legality” principles, proclaimed expressly in the Declaration with a narrow relation to the “right to decide.”

The entire Court, leaded by Francisco Pérez de Cobos, maintains that “the basis of the constitutional order” can vary, as long as it is not done “by means of an activity which infringe the democratic principles, the fundamental rights or the rest of the constitutional mandates”, but in “in the framework of the constitutional reform principles.”
